These terms of service (the "Terms of Service") constitute the entire agreement concerning the provisions of ground transportation services between you and VMG Concierge Service Ltd. ("VMG") and stipulate the terms and conditions of your use of the website located at https://www.vmgtours.com/ (the "Web site"), Web applications (if and when applicable), mobile applications and online services (all services will collectively will be referred to as the "Services") The Services are provided solely for your own use.
The nature of the Services that VMG provides may change from time to time without prior notice to you. In addition, VMG may cease (permanently or temporarily) providing the Services (or any part thereof) to you or generally to other users with or without prior notice.
Acceptance of Terms. Your use of the Service is expressly conditioned on your compliance and consent with these Terms of Service. By completing the booking form and accessing or using the Service, you are indicating that you agree to be bound by these Terms of Service. VMG reserves the right to amend, discontinue, limit, disable, terminate, or cancel any feature of the Service.
Changes to the Terms of Service. VMG may, in its sole discretion, make changes to these Terms of Service, from time to time with or without notice to you. Each time changes are made to these Terms of Service, a revised version of these Terms of Service, will be posted on this page. You can determine when the Terms of Service were last modified by checking the "Last updated" notice on the top of the Terms of Service. Your continued use of the Service following such changes constitutes your acceptance of any such changes. You can review and are encouraged to check, from time to time, the most current version of these Terms of Service. At all times, the latest version of these Terms of Service shall be binding and prevail over any other version.
Privacy Policy. VMG respects the privacy of its registered users and visitors. Any information that you provide to VMG through the Service is subject to VMG’s Privacy Policy which can be found on https://vmgtours.com/en/privacy-policy and is hereby incorporated by reference. Your use of the Service constitutes your consent to the collection and use of your personal information, as described in the Privacy Policy.
| Eligibility. The Services are available only to individuals who (a) are at least thirteen (13) years old; and (b) possess the legal capacity to enter into these Terms and to form a binding agreement under any applicable law, or have received the required consent from their legal guardian to enter into these Terms. Therefore, you hereby represent that you possess the legal authority to enter into these Terms and to form a binding agreement under any applicable law, to use the Services in accordance with these Terms, and to fully perform your obligations hereunder. If you are between the ages of 13 and 18, you represent that your legal guardian has reviewed and agreed to these Terms. Individuals under a certain age who have the express consent of their legal guardian may nonetheless be prohibited from using the Services due to age restrictions specifically applicable to

The Services. |
(A) You shall be responsible for the behavior of all the passengers in the car during the Journey. You will be charged US $50 to cover cleaning costs in the unlikely event of the vehicle being soiled by any passenger.
(B) VMG shall not be responsible for any delay caused by your failure to allow enough time to reach your destination or if the passengers are not ready for collection at the booked time.
(C) Eating, drinking and/or smoking in the cars is not permitted.
(D) All children travelling during the journey should be restrained in a manner appropriate to their age, weight and height. Suitable child seats should wherever possible be supplied and fitted by the child’s parents.
(E) VMG shall not carry more passengers than its insurance or licensing allows.
Obligations. You shall:
(A) Provide the required information on the booking form so as to allow VMG to properly perform its obligations. In case incomplete or inaccurate information is provided, VMG reserve the right to modify the services cost on a unilateral basis or refuse to provide the Services and seek recovery of losses from the customer.
(B) Arrive at the points of pickup by the time specified in the booking form. If your pick up is from an inbound flight at an airport and you fail to appear within 60 minutes from landing time or otherwise at any other location and you fail to appear within 15 minutes, your order and the service shall be deemed to have been executed and provided, and you shall not be entitled to a refund or repayment.
(C) Treat third-party property with proper care, observe the rules of use established by third parties for such property, refrain from damaging third property.
Log-in details. You are entirely responsible for maintaining the confidentiality of your password and account information. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify VMG immediately of any unauthorized use of your account or any other breach of security. VMG will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by VMG or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the express permission of the account holder
Rules of Conduct. As a condition of use, you agree to use the Service solely for lawful purposes and not to use the Service for any purpose that is prohibited by these Terms of Service. You are responsible for all of your activity in connection with the Service.
Proprietary Rights. VMG retains sole and exclusive ownership of all rights, title and interests in the Services and all intellectual property rights relating thereto, including without limitation,VMG’s trademarks. This provision shall survive termination and expiration of this Terms of Service and shall remain in full force and effect thereafter. Without derogating from any of the provisions herein, you agree not to decompile, reverse-engineer, copy, transfer, assign, rent, resell, distribute or use any of VMG’s proprietary rights in the Services (or any part thereof, or any software underlying the Service), other than as expressly authorized by VMG.
Cancellations and Refunds. Cancellations must be made by you using our website or any other mode of communication established between VMG and yourself. You will be entitled to a refund, depending on when you cancel your booking as follows:
(A) If you cancel your booking more than 12 hours prior to the booked time, you will be entitled to a full refund of the value of your booking.
(B) If you cancel your booking less than 12 hours but more than 6 hours prior to the booked time, you will be entitled to 50% of the value of your booking.
(D) You shall order a suitable vehicle for the number of passengers and luggage. VMG cannot guarantee to carry excessive amount of luggage. Please note that a child, no matter what age, counts as one passenger.
(C) If you cancel your within then 6 hours or less prior to the booked time, you will not be entitled to any refund.
(D) If you made a special request in your booking (i.e. requests which are of the ordinary course of business, for example: a unique vehicle, a driver who speaks specific language etc.) and you cancelled your booking, VMG shall be entitled to offset from your refund amount any out-of-pocket expenses incurred by VMG in its efforts to meet your special request ("VMG Expenses"). If you are not entitled to a refund, you shall reimburse VMG for the VMG Expenses within 7 days from cancellation.
Liability.
(A) VMG shall use all reasonable endeavors to get you to your destination on time, but shall not be liable for any loss due to delays caused by road or traffic conditions beyond its control on the journey. Under no circumstances shall VMG be liable (in contract, tort, or otherwise) for any loss of profits, business or for any indirect or consequential loss whatsoever.
(B) All luggage is carried entirely at your risk.
(C) VMG shall be entitled to cancel all services and provide refunds in the event of a declared national emergency, riot, war, fuel shortage, extreme weather or terrorist attack, or other circumstances beyond its control. If the vehicle breaks down during your journey, VMG will endeavor to arrange an alternative car to complete the journey as soon as practicable.
(D) THE SERVICES MAY BE USED WITH THIRD PARTY PROVIDERS, BUT YOU AGREE THAT VMG HAS NO RESPONSIBILITY OR LIABILITY TO YOU RELATED TO ANY TRANSPORTATION SERVICES PROVIDED TO YOU BY THIRD PARTY PROVIDERS OTHER THAN AS EXPRESSLY SET FORTH IN THESE TERMS. LIABILITY FOR DAMAGES TO LIFE AND HEALTH OF PASSENGERS IN CASE OF A TRAFFIC ACCIDENT SHALL BE REGUALTED AND GOVERENED IN ACORDANCE WITH THE RELEVENT LAW APPLICABLE TO THE PLACE OF OCCURRENCE OF THE ACCIDENT.
(E) YOU SHALL INDEMNIFY VMG AGAINST ALL LOSSES, COSTS, DAMAGES, AND EXPENSES ARISING FROM ANY ACT OR OMISSION OF ANY PASSENGER IN YOUR PARTY.
Termination. VMG will refuse or terminate any booking with immediate effect if it places any driver or vehicle at risk of damage, violence or abuse by you or by any passenger in your party and will ask all passengers to vacate the vehicle as soon as it safe to do so. No refunds will be given if the journey is terminated part way through the hire.
Miscellaneous.
(A) VMG may subcontract its obligations under this Terms of Service. You shall not assign, transfer or delegate any of your rights or obligations under this Terms of Service.
(B) These Terms of Service constitutes the entire agreement between the parties concerning the subject matter hereof
(C) These Terms of Service shall be governed by, the laws of the State of Israel without giving effect to any principles of conflicts of laws thereof, and the eligible courts in the district of Tel Aviv shall have exclusive jurisdiction over all disputes between the parties related to this Terms of Service.
(D) If any part of these Terms of Service is found void and unenforceable, it will not affect the validity of the balance of the Terms of Service, which shall remain valid and enforceable according to its terms.
(E) The failure of VMG to act with respect to a breach of these Terms of Service by you or others shall not constitute a waiver and shall not limit VMG’s rights with respect to such breach or any subsequent breaches.
